Subject: Screwed by KIA Finance Department

Me and my partner came in February 2010 to see if we could get a new car because we were screwed on our last loan by Ganley. We had heard great things about Kia company and dealerships that we wanted to give it a try. What we needed to do is figure out what to do about our Chrysler Sebring. Since we couldn't trade it in because our payment would be too high, we spoke with Johnnie Rebant. He had told us that the car could be wiped clean if we relinquished the loan and Kia would take over and Johnnie said he would call First Merit to tell them where the car is at and why. We had said that we were concerned that the bank would come after us because we had never heard of anything like this, but Johnnie reassured us with a previous story about someone else doing the same thing and the bank was trying to come after them. He said that they can't come after us. Had he not said that this was an option, we would have walked right out the door. So we drove the KIA off the lot and left our Sebring there.

Now for the past several weeks, First Merit has been calling us twice a day wondering where the payment was. Obviously the ball was dropped and Johnnie had never called like he said he would. I have spoken with First Merit about the situation and also gave them Johnnie's contact information and have also contacted Johnnie myself and he said that he would call them. When he did call them finally in April, he told First Merit that we had voluntarily gave up the loan which is not true.
This is bad business and extremely saddening that future customers may get treated the same. Please contact me at your earliest convenience because I simply can't keep calling Johnnie and not have anything done.

He never returns my phonecalls, I just happen to catch him while he is in. Mr. Midcap has not returned any of my phonecalls as well, along with emails I have sent him.

As of now, we are 3 payments late on the Chrysler Sebring, the car is on hold for Repo until they find out exactly what happened, and First Merit is wondering why the guy at Kia did not do his job and offered us this crazy option. We are more than determined to go to Kia corporate and already have legal representation. They just want us to try and rectify this ourselves before we get legal about hings. Beleive me, we don't want to go this route if at all possible.

We are inquiring a meeting with you and possibly Johnnie to get this situation under control as soon as possible. Whether we just take back over the Sebring again and we return the Kia (without trouble of course seeing as we only paid one month and were coherced into signing another lease under fraudulent information given to us by Johnny), or that Kia, as in our agreement with Johnnie, will take over the Sebring and wipe the slate clean.

Why Johnnie would keep on telling us this lie about how the bank can't come after us, he tells us this everytime we have come in to talk to him. This will also be addressed and rectified.
