Sylvia,
I am guessing based on your question that you do not have a written contract with your nanny. This is one of the many issues that a written contract helps to clarify for both you and your nanny. I would strongly suggest that after you return from your vacation, you sit down with your nanny and write one up. You can find a pretty comprehensive on on www.lifewithnanny.com. In the mean time, the other poster, Michelle, I believe, gave you good advice. First off, if your nanny is a live-out nanny, she is totally correct in asking you to pay her hourly, as you are required to pay her an hourly salary, and the according overtime by the Fair Labor Standards Act, but that does not mean that she should not have a "guaranteed" wage. She has committed to working for you, and making herself available to your family for childcare, and she cannot just run out and find another job just because you are going on vacation (or choose not to use her services for any other reason), but you can, in turn, feel free to ask her to come in and work on projects such as sorting through the kids summer clothing and donating those that no longer fit, re-arranging the kids closets or toy rooms, etc.. So, while you do need to pay her for her time, regardless of the terminology used to describe her method of payment, you can also ask her to assist with child related tasks while you are gone that might otherwise be difficult to accomplish while attending to the immediate daily needs of your children. Have a great vacation!
>we are preparing to go on vacation. our nanny has
>wanted us to pay her using an hourly scale. what do
>we do, then, when we go on vacation. we are not
>planning on taking her with us.
>
>since she is not on salary, what is our obligation
>with regards to her pay while we're gone?
