Butch, What you are missing is that the HOA is NOT a part of government (rights do not apply). The HOA is a Corporation of which you are a member (Stockholder). There are some laws to govern them, but most fall under contract law. When you bought your property, you agreed the the Covenants and Bylaws (both Contracts). The Bylaws give the board of directors the ability to get things done that need to be done. Without the board of directors, little things would not get done.
