Subject: Biker who hit stray sheep asked to pay for road damage

A motorcyclist who was hospitalised after hitting a stray sheep has been told to pay for damage done to the road by the local council. Moray Ferguson, 47, was in intensive care after the accident in July. Mr Ferguson suffered injuries including a broken hip socket, pelvis and collarbone, seven cracked ribs and a collapsed lung

He has now been sent a bill by Aberdeenshire Council for £200.

Mr Ferguson was told by Aberdeenshire Council that it is standard practice to bill someone involved in an accident. A spokesman said "We regret that the motorcyclist was injured but we contact individuals involved in accidents which cause damage to our property directly. It gives them the option of putting it to their insurers, or paying for it themselves if it's a minor claim and they don't want to affect their no claims bonus."

If Mr Ferguson reads this, then please note there is a legal precedent. In May 2007, Motobke.co.uk reported the case of Robert Purdie. Mr Purdie, 61, was hospitalised for four days after a deer leapt out in front of him, resulting in a fractured knee and collar bone. Despite this, he managed to move the carcass out of the road – only to be sent a bill by Argyll and Bute Council for the cost of the clean-up operation.

But after Mr Purdie consulted solicitors, he was told the claim had been dropped.
