High awards punish the offenders and make sure they're more careful next time. It's the insurance companies who choose to punish even the good doctors with higher premiums. It's their own fault they pay out so much, they settle stupid claims, when they should fight. They say it's easier to settle than to fight, so then other frivolous claims pop up because of that thinking. So now because of "tort reform", those who truly are damaged cannot get justice simply because the insurance companies made bad business decisions in the first place. Why do real victims have to pay for the insurance companies' fiscal incompetence?
