Why are we so certain that the hospital was guilty? There's no relationship between C-section rates and cerebral palsy rates; this particular baby had pre-natal problems long before the C-section. Seems to me that Fieger was hoping to make millions off of another family's tragedy regardless of whether there was any malpractice. Of course, $30 million-verdicts for happenstance is a good way to drive obstetricians out of business from insurance costs, guaranteeing that there will be far more infant mortality than if the lawsuit hadn't been brought. (A study by Professor Klick shows that states with medical malpractice caps have lower infant mortality rates than states without caps.) But we never hear about the infants who die because plaintiffs' lawyers suck millions out of doctors' and patients' pockets and reduce the availability of pre-natal care for the poor.
