Had the hospital performed surgery faster, this would have been avoided. That was the belief. I wasn't at the trial, so I don't know all the details, but Fieger would not bring a frivolous case. He only takes cases in which he believes an injustice has been done. And yes, he probably only takes cases he thinks he can win too. So there must have been something there.
There should be no caps on medical malpractice because someone's life's worth shouldn't be judged by the state who doesn't even know the circumstances. Judgement should be left up to the jury who actually looked at the case. Judges should indeed throw out frivolous cases, but if this particular case was so frivolous, why didn't the first judge throw it out? The MI Appeals Court should have just reduced the judgement, not thrown the entire thing out. This family deserves some justice if indeed the doctor did wrong.
I have to agree there may be indeed too many lawsuits against doctors, they can't be held responsible for every entire thing that goes wrong. Some of it is God and nature's will. But if they really indeed did something clearly wrong, like that other story about setting the baby on fire, they need to be held responsible!
