http://www.rangelmd.com/2004/10/defensive-medicine.html Lawyers bring cases claiming otherwise because they can find experts-for-hire to testify to that effect and then make millions persuading a lay jury to blame the doctor for the cerebral palsy. That's not "frivolous" in the legal sense that a judge can throw it out before trial, but you and I pay higher prices for medicine to pay the multi-million dollar jackpot fees John Edwards and Geoffrey Fieger get for bringing and winning these bogus cases.
That a jury decided something doesn't mean that the verdict shouldn't be thrown out if there wasn't a fair trial, and if Fieger broke the rules by sandbagging his damages evidence or giving a closing argument that stepped over the line, then the judge made the right decision. (It's Ohio, not Michigan, and the trial court, not the appeals court, though Fieger has had cases thrown out in Michigan, too: he's a repeat offender in this regard.)
