Subject: DOC and Tobacco

The DOC is so wound up over offender use of tobacco and, supposedly has been since August 1997. However, the policy makers who changed the ADP have effectively, caused the
tobacco problem to proliferate more by adding the Class C offense 369-C.

At our facility, when the only available offense was the Class B, the problem of offender smoking almost completely stopped after several offenders were charged and appropriate sanctioned were given. It was a wakeup call to the offenders and, it got their attention.

As a result of reinstating the Class C offense, the DOC has in effect, shot itself in the foot. Adding the Class C offense only created more problems for facilities. Offenders know that if they get a Class C, report, sanctions are not going to be nearly as severe as they are for a Class B offense.

If the DOC wants to show that it is tough on the monster that it created, then, it should get tough.

Absolutely, get those that traffic...public and staff, and stop giving the offenders "every break in the world" and do what should have been done all along.

DOC created this monster and should "fix" the problem it created, not add to it.
