蘇格蘭繼英國和威爾斯之後，也將在未來幾個月內修法，讓同志伴侶可同時辦理收養登記。蘇格蘭政府說，新的收養法將讓同志伴侶兩人一起分擔法律權利與責任。

蘇格蘭的同志雖然已可合法收養子女，但目前僅能以個人身份辦理登記，女同志經由人工授孕生下子女，卻不被認定為小孩法定母親的事，也時有所聞。

在英國民事伴侶法(CPA)即將生效之際，蘇格蘭修改相關法律齊步跟進是意料中事。主管機關說，新法可疏解目前待領兒童人滿為患的窘境；英國全國收養成左漁蚳珓鬮礞U降，釵h機構認為問題出在無效率的官僚作業。

10日公佈這項消息的教育部副部長羅伯森(Euan Robson)說，新法將解決「混淆的法律定位」問題，所有改革將以兒童的利益為優先考量。未來申辦的作業天數也可望縮短。羅伯森已就修法展開評估，特別是針對民事伴侶法實施後的潛在問題進行研究。

蘇格蘭收養法學者前不久曾呼籲政府取消對同志伴侶的收養限制，同運團體石牆駐蘇格蘭分部也支持政府修法。然而，天主教會對此相當不悅。蘇格蘭天主教主教歐布萊恩(Keith O'Brien)，堅稱只有異性戀家庭可讓下一代健全成長，指責這個決策違反公眾利益。某些議員也反對修法，他們可能要求舉行自由表決。
