據《僱傭條例》規定,僱員連續工作四周、每周工作不少於18小時(俗稱「4.18」),便視為「連續性合約」並受法例保障。若不足「4.18」,則屬兼職工。首宗工人挑戰僱主走法律罅逃避「4.18」的案件,事主朱財芬曾在吉之島服務16年,她說每日工作最少8小時,但每工作三周後,被安排放假一周,因此無法享有長工福利。她向吉之島追討長期服務金及有薪假期等約10萬元賠償。


稱非連續性合約

吉之島的代表在庭上反駁,指事主並非用連續性合約聘用,因此吉之島無責任支付有關賠償。勞審處審裁官昨日將案件押後,等候雙方提交法律意見書。審裁官形容,今次案件將成為重要案例,也預計敗訴一方或會提出上訴,遂建議雙方先參考高院上訴庭類似案件的裁決。協助朱女士的成衣、文職及零售業職工總會總幹事張麗霞指出,《僱傭條例》第五條及附表一列明,僱主無安排工作而要員工休假,並不視為終斷連續性的僱用,工會極有信心勝訴,並考慮直接入稟高院提出索償。
