Subject: Military Betrayed by Congress!!

The 109th Congress has ended without any action on Public Law 97-252 (Uniformed Services Former Spouses Protection Act), which has again allowed for the continuation of our career military members compensation being garnished by state courts as marital property, until death. Even the United State Supreme Court ruled in 1982 (McCarty) that State courts could not award military pay as marital property. The high court clearly stated, “The application of community property principles to military retired pay threatens grave harm to clear and substantial federal interests.”

The USFSPA law has clearly shown that Justices are truly blind when it comes to protecting those who many in our country refer to as heroes. How blind and unresponsive our national elected officials, the Defense Department and the judicial system have been over the past 24 years regarding this unjust law, which was even backdated so as to appear it was approved before the United States Supreme Court McCarty decision.

How long will the American Taxpayers be willing to see that their Tax dollars, which were approved to support National Defense is going to support those who have no contract to serve our country? Wake up Congress and repeal the unjust taking of military pay as marital property before it becomes necessary to reinstate the draft.
