Just finshed listening to the episode, I'd say there's definitely a story along the lines of 'The Smoking Babes' in this idea.
As to the other author's who anticipated this kind of thing in the 1990s, An4's 'A Fine Way To Start' comes close, although in that story it's more a case of parents being fined if their teenagers smoke in their own houses.
The other turned out to be SStoryman's 'Smoke Police' a clear case of a good plot idea, but poor execution.
