the point was if the DA believes he is innocent but prosecuted him anyway, or now believes he is innocent and doesnt stop the execution, then he can be charged with murder. Also on the case there's no doubt he did it, the question is why, some claim self defense, that the cop shot him first, now if thats the case the first two shots could be self defense, but the putting the cop on the ground, where is he not struggling and not fighting, then killing him execution syle in the head, could NOT fall under self defense
