In the scene before the one when he was shot, Spender was recommending to Kersh that M & S be put back on the X Files. He then said he was going to clear out his office. One might safely assume that M&S believed he had left the FBI, even perhaps temporarily on compassionate leave. He had just lost his mother in horrendous circumstances. I suppose the only question for them in the months to come might be "Hmm, I wonder what ever happened to Spender" Maybe they pondered it for a while and then presumed he *had* left. I suppose if CSM (and/or whoever helped him)had done a good enough clean-up job to make it look like Spender had taken all with him (including his blood!), then there would be no need for further questions.
