為解決入境旅客攜帶超量菸酒涉刑罰問題，財政部新修正菸酒管理法第46條第3項及第4項規定，對於入境旅客隨身攜帶菸酒超量未依規定向海關申報的行為，予以除罪化，改處行政罰鍰，將自明年元月1日施行。

基隆關稅局表示，入境旅客需年滿20歲，可攜帶菸酒免稅數量為酒類1公升(不限瓶數)，捲菸200支或雪茄25支或菸絲1磅，若超額可改走紅線檯通關，完稅後放行。

自明年元旦開始，超額後未走紅線檯通關，將不會再移送法辦，改由海關分別按每條捲菸、每磅菸絲、每25支雪茄或每公升酒，處新台幣500元以上、5000元以下的罰鍰。
