My husband and I attended a presentation at Castletown Promotions in Taunton,for Atlas Vacation Owners Club, who are wholly owned by RMI Gibraltar, where, having declined to sign up for the full 'points system' being offered at £8500.00, we were offered a membership that we were told was a 3-year trial membership for £2100.00 ( It turned out on close inspection to be 2yrs 11 mths and 30 days!) We signed up for this, but paid no money. Away from the hype and the high pressure selling, we realised we did not want to be involved with this, so cancelled immediately by recorded delivery, returning everything we had been given. Needless to say, the authority to proceed which we had both signed contained a non-cancellation clause. We are now refusing to pay any money, despite the threat of being taken to court. A legal advice line suggested that they would have trouble getting judgement for the full amount, although we might have to pay a proportion. Has anyone out there been taken to court on a similar claim, or have any more information that may help us? I have threatened to report them to the OTE if they insist on pursuing this, as their code of ethics says that these holiday packages must allow a 10 day cooling-off period.
