I do think that Mulder believed that the decision was already made before the trial started. That came clear when Scully had the proof *scientific proof* that Mulder was innocent yet they called her out of order.

I also think Mulder saw a glimmer of hope during the proceedings. Gibson said three judges where waivering. There was 5 wasn't there? Kirsch and the alien were on the conspiracy to find him guilty but what about the others? If they had heard what Marita had to say, given the chance, or given the opportunity to inspect Scully's findings, would they have found him innocent?

*sigh* I love that it left us with so much to discuss. Makes the episode a 10 in my books.
