There are no unsurmountable legal problems, whether you are a gestational or traditional surrogate. In case of a contract (this is contractable), the baby will belong to the intended parents.
The only exception to that rule is when the baby was conceived without a binding contract OR through normal intercourse. In case of latter, the contracts will not apply, so both parties can walk out of the arrangement at will. Wishing all the best
