Joshua DeRosier, a 19-year-old Brainerd man, was accused Tuesday in Crow Wing County District Court of murdering his grandparents on Christmas Eve while they slept in their home.

DeRosier, charged with two counts of second-degree murder for the deaths of 68-year-old Theodore "Ted" Bieganek and his 64-year-old wife, Angeline "Angie" Bieganek, appeared before Judge David Ten Eyck in a Social Service building courtroom.

Ten Eyck set cash bail or bond at $500,000. One of the conditions of bail is DeRosier have no contact with family members. DeRosier is scheduled to make his next court appearance 1:30 p.m. March 11. He is being held in the Crow Wing County Jail.

John Sausen, assistant Crow Wing County attorney, said the state would convene a grand jury to consider first-degree murder charges.

DeRosier stood in the hearing and showed no expression, answering only "yes" and "no" to Ten Eyck's questions. Public defender David Hermerding represented DeRosier.

Crow Wing County Sheriff Dick Ross said DeRosier had been a suspect almost from Day One after the murders.

"We started putting together the case and we realized it had to be someone in close proximity" to the Bieganeks, said Ross. "But because there were no witnesses, no suspects at the scene (of the murder), these things take time, we had to put together, the forensics part of it."

DeRosier was arrested Tuesday morning at the Law Enforcement Center in Brainerd. DeRosier didn't admit to the killings Tuesday, Ross said, but only made the same general statements he has made in earlier interviews.

DeRosier used to live with the Bieganeks, and still had a key to the back door. At the time of the murders he was living at the Paul Bunyan Motel.

The criminal complaint, filed in district court Tuesday, stated DeRosier had recently bought a 2000 Chevrolet extended cab pickup for $24,000 and his grandmother, Angie Bieganek, had co-signed the loan. At the same time Angie Bieganek and DeRosier also applied for credit life insurance, so that if either one of them died the truck would be paid for.

DeRosier was unable to make payments for his truck and Angie Bieganek had refused to help make the payments for DeRosier.

The sheriff's department reported DeRosier had told a friend he wished something would happen to his grandparents because then his truck would be paid off, and he told another friend that he had a dream his grandmother was dead, according to the criminal complaint.

About 11 a.m. Dec. 24, the Crow Wing County Sheriff's Department received a 911 call from DeRosier, stating he found his grandparents, Ted and Angie Bieganek, shot in their bed.

When Crow Wing County deputies arrived at the scene, they found the Bieganeks' front door off its hinges and glass in the door was broken. The Bieganeks' bedroom was about 50 to 60 feet from the front door. Inside the front door deputies found a large, metal woodworking clamp on top of the broken glass.

The Bieganeks apparently were asleep when they were shot. Officials said the couple was dressed in sleeping clothes and was under the covers. The coroner's office reported the couple had been dead for eight or nine hours before deputies arrived.

Ted Bieganek was shot twice in the head, Angie was shot once in the head. Along with three spent shell casings from a .22-caliber weapon, a .22-caliber slug was found.

Among the shell casings it was observed that a slug that struck Ted Bieganek in the head also struck his wristwatch, breaking it. The damage caused the watch to stop at 2:10 a.m.

According to the criminal complaint, on Dec. 22, DeRosier went to the residence of his uncle, Greg Schley, to see if he could live there. At that time Schley was at the back of the house cutting wood. The sheriff's department stated DeRosier admitted entering the residence to go to the bathroom.

On Dec. 25, Schley discovered his Marlin Model 60 .22-caliber rifle was missing. Law enforcement recovered three spent shell casings at the Schley residence that had consistent markings as those found at the Bieganek murder scene.

On Dec. 23, the criminal complaint reported, DeRosier went to visit his Grandpa Veit's residence and requested .22-caliber ammunition so he could train his dog not to be gun shy. During that time, DeRosier also had access to ammunition in a former girlfriend's car. Both are the same type of ammunition found at the Bieganeks' house.

The .22-caliber gun used in the murders was found Saturday on the embankment between Excelsior Road and Movies 10 in Baxter. The gun was loaded when it was found.

Ted and Angie Bieganek were married in 1996. DeRosier is Angie Bieganek's grandson and Ted Bieganek's step-grandson.

The murders remain under investigation to determine any possible accomplices of DeRosier, Ross said.
