Subject: 36CRF228 as published in the FR on July 9th 2004

This post is in response to the emergency rule 36CFRF228, as published on July 9th in the Federal Register. As a quick background it is the ruling that has been referred to in the thread originally posted on this and other forums by Reno Chris.

In this emergency new rule making measure, what was originally phrased as a "significent disturbance" is now a "disturbance." What exactly will be a disturbance? It is evident the ruling is directed to small mining operations by maybe just a couple of individuals--- and this emergency
"disturbance(?)" could be no more than just panning a sample of gravel---.

Then a "notice of intent" could be deemed as necessary. This would require time to fill out the paper work and then a wait to see if approved. Then, maybe someone in the NFS decides that an "environmental impact analysis," or a
"plan of operation" is needed.

Why is there now an emergency measure? If it is not challenged and becomes permanent; more of our "rights" as individuals will be lost. Then if it becomes "permanent," what other rights will be next? Is it a "given" to be locked out of "our" National forests and other lands by agencies drawing "their" paychecks from us?

Would it now be all disturbances? fishing, horseback-riding, hiking, outfitting, bird and critter watching, camping; with the argument by the NFS that all of these activities will create a disturbance of some sort. Even to making a noise could become a disturbance---.

You all have the freedom of choice, such as ; or write letters and postcards to the Forest Service USDA; or write letters and postcards to the senators who are on the Forestry committee; or phone the White House.

I'm not going to tell you what you should do; letters, donations to legal funds; or--- whatever. It is up to you. I just wish to let you know what could happen.

However, to close on a positive thought, I can see that throughout all of America, from Maine in the northeast, to CA in the southwest, there are a lot of very responsible users of our National Forests. They are also very concerned about our National forests and are working together with the NFS to properly manage our National Forests. All is still well with the United States of America.

Thank you Reno Chris for all of your considerable effort in bringing this to our attention, in a very reponsible and professional nmanner in the various postings you have made.
