189) Control of the episode "dominio de los hechos": Refers to the situtation in human rights violations in which a person, perhaps a commanding officer, knew what was going on and had control over it, though he may not have actively participated. Ideally, trials should hold people personally accountable for crimes but should not exclude convictions based on theories of command responsibility and "dominio del hecho." Attempts to bring human rights offenders to justice, for example, those surrounding Pinochet, have included the argument that the commander had control over the situation and should be held accountable.
