Copyright Requirements.
(Myths and Misconseptions)

Copyrights apply to 'original' works of authorship fixed in any tangible medium of expression.

- a websight may be copyrighted as to design and original content,however content that is already copyrighted by someone else may not be included in the copyright .

Original means basically not copied. The work need not be completely original, but may not be merely a variation and/or derivitive of another existing work.

- eg. an original pic scanned and posted on a site can be copyrighted...a screen grab taken from a home video can be copyrighted..however a screen grab taken from a video of a tv show that is already copyrighted may not be copyrighted..
- the still image captured from the video is still legally
the property of the shows producers and the TV network broadcasting the show.
example: Worst Witch Screen grabs made in Canada would be copyrighted and legally owned by Galafilm/Multi-Media in Montreal and by YTV .
Therefore I couldnt possibly claim legal copyright to the images as they are allready owned and copyrighted by at least 2 other companies.(unless i enter into an agreement/permission with those who hold the copyright...like CP16 did with gala and citv)

The same copyright laws regarding the internet and copyright laws apply worldwide(with minor variations) after the 1998 intellectual copyright agreement.(washington DC)

the same laws apply to backgrounds containig the likeness of copyrighted materials..wether altered or not.

If the Images are copyrighted already they cannot be 're-copyrighted' tho the images have been altered.
(unless there is an agreement between the parties)

So,while i may have 800+ worst witch screen grabs in my gallery,I can not claim any copyright on any screen grab wether i made them or not.

i can claim copyright on my gallery design...but thats all

all i had to do was e mail Galafilms Legal department and they were more then happy to fill me in about copyright myths and misconceptions

Note: CP16.com ( who have the best worst witch screen grabs online)have an agreement with Citv and permission from Galafilm to use the worst witch images...the agreement with Citv includes Having the Citv Logo on every worst witch pic on the site

CP16 thru this agreement can claim copyright of the pic...

simply deciding you own copyright for something online doesnt mean u actually do...

it just means you think you do...
