City Works to Root Out Signs Stuck on Trees

In an effort to rid the city's trees of unsightly and potentially harmful flyers, legislation has been introduced before the City Council that would dramatically boost fines for those caught illegally posting notices on them.
"These flyers — which often advertise shady weight-loss schemes, mortgage brokers or work-at-home jobs — can be misleading," said Councilman David Weprin (D-Hollis), a co-sponsor of the new legislation, "and they are always eyesores that devalue a community."
At a news conference on the City Hall steps Wednesday, Weprin and Councilman Michael McMahon (D-Staten Island), chairman of the Sanitation and Solid Waste Committee, announced their support of a series of bills that would strengthen the city's laws that crack down on guerrilla advertising.
"There has been an increase of these kinds of signs everywhere, and especially in Queens," Weprin said. "We must prevent this and make those who do it pay."
The 1985 law that made it illegal to post advertisements on trees, telephone poles, benches, and other property maintained on city streets carries with it a fine that ranges from $50 to $125 for a first offense and $100 to $225 for a second.
A bill being considered by the Sanitation Committee would double the fines for a first offense to $100 to $250 and to $200 to $450 for a second infraction.
Weprin's new proposal — co-sponsored by McMahon — would boost the fines further: a first offense for posting on trees would carry a price tag of $200 to $500, and a second incident would cost $400 to $1,000.
The councilmen said they were particularly conscious of trying to prevent advertisers from damaging trees by nailing or stapling signs to them.
"This bill is especially crucial because it also goes to protecting the trees, which are very critical to what makes our city beautiful," said McMahon, who was flanked by former Parks Commissioner Henry Stern and other environmental activists.
"[The trees] are so very important to our quality of life," McMahon said.
The bill — expected to be placed on the Council's August agenda — also would give the Sanitation Department the ability to subpoena phone records to catch the sign posters, in addition to offering rewards to citizens whose tips help collar the illegal advertisers. END OF ARTICLE
