Subject: State Farm Insurance, POSSIIBLE BAD FAITH.

Purchased brand new MFG. home in May of 1998. Moved in around June 6 1998. There were various problems with the new home,( usual stuff ) and the floor of our laundry room was warped, it was like waves on the ocean, not flat. Anyhow, to make this over two year long story as short as possible.

Ther was a water line that was not connected, came loose or ??, it was not broken, seemed just not connected.

The water flodded an area of the home apx. 15ft wide by apx 30 ft long.

Mfg. sent repair guy ( 1 ) who did stop water, a week after I called, and said " Iam not prepered to handle this damage today, they said it was a loose floor board"

He returned a week later ( water in walls, floors and home for apx. 3 1/2 weeks now ) and had a helper, his son I think, and cut the floors up and put in new boards.

We are not construction experts by any means, but we new that we paid $ 51,000.00 for a brand new home now severely damaged, but repaired !!.

We complained to Mfg. that the water soaked drywall and other wet area's were not replaced, were showing discolorations, bubbles in linoleum etc. and several weeks later another crew was sent and they tore up previous repairs and seemed to be doing a better job, that is until I had to go back to work and could not suppervis them any longer.

They, the second repair crew, left the same water damaged drywall and told my wife, when she asked, why are you sweeping the sawdust and debris onto the insulation, and not throwing it away that, " the sawdust and debris will increase your insulations R value and lower your utilitys bill"

My family in late Sedpt. Oct. of 98, started having health problems, allergys, rashes, headaches, cold flu symptoms, and lots of other issues not faced by us before.

I made a claim for the water damage to OUR INSURANCE COMPANY STATE FARM, and they DENIED THE CLAIM telling us that it was a manufacture problem, go after them.

I called, infuriated, my agent, and asked him why are we paying for insurance, we cant use??

A week or so later I was told WE HAVE COVERAGE, how nice.

Then soon after we were asked by our Dr., due to the attack of recent health problems on my family that we could have a mold problem, if we had had any water leaks, damage in our home.

Talk about light bulbs going off in your head, I decided to open up the wall were the water leak was to see if ther was any mold or ??

The wall, inside the wall cavity, was covered in black slimy mold, the same wall that was not replaced by the first repair, second repair and still had the black crayon, my sons, that i used to write REPLACE on the drywall.

We left the home on that day, May 19, 99.

We have been fighting with State Farm to replace all of our mold and spore ruined stuff, they have agreed that we have coverage for the mold, BUT IT ONLY WILL CLEAM OUR STUFF NOT REPLACE IT AS OUR POLICY STATES, we have a guaranteed replacement policy.

They did pay for some of our furniture to be replaced?? couch chair loveseat and some cushions and stuffed animals.

Yet they say we can simply wash our clothes and all will be ok ??

I am contacting several other families, same issues same treatmentr, and am looking into the possibility of a CLASS ACTION LAWSUIT for this gross misconduct of insureds.

There was a school in Yuma, AZ that the insurace co.( unknown) gave a report that the mold and water damage could be cleaned up for $ 40,000 and the school would be closed for about three days for repairs.

About a week later, the remediation co. hired by the school stated, per the AZ republic newspaper, that the school is closed indefinately, and the cost to remove the mold and spores will be 1.4 million dollars, including the replacement of all school band and football uniforms, why can't they be washed ???

cheapskates, State Farm, billion dollar co. saving money at your family's health and property.

STACHYBOTRYS HAS ALMOST DESTROYED MY FAMILY, HEALTH AND OTHER PROBLEMS, REQUEST YOUR COMMENTS, IDEAS ETC.
