I realised after posting that my reply was not terribly clear, so here's another go:

Our understanding and the advice we have been given is
that up till now it would not have been legal under
the Rehabilitation of Offenders Act to require CRB Disclosures from people simply on the basis that they are current or prospective residents. As I wrote in an earlier post, CRB checks are required for employees and volunteers working with children or vulnerable adults (where legally allowed).

We are currently talking to the police and Social Services and looking into how the Vetting and Barring Scheme changes how these risks can be managed.
