I think Jayne's history is part of the reason that Mal let him live. He must feel at least some responsibility for how things went down. He took a risk, one he was aware of, by leaving the Tams with Jayne. He was wrong about it paying off. He was the one who added Jayne to the team, and basically rewarded him for the opportunistic behavior he's still exhibiting. Jayne is in some ways his responsibility. I doubt, no matter how angry he was, that he really wanted to kill Jayne. But at that point he wasn't seeing any alternatives. His efforts to incorporate Jayne into a useful part of the crew hadn't taken the way he hoped. Jayne's last request was the only thing that saved him. He's getting one last chance, because Mal can at least hope that the opinions of his ship mates may give him some hold over Jayne's behavior that abstract concepts of authority and loyalty didn't. But it's definitely Jayne's last chance. And if he betrays them again he'd better make sure Mal's dead. (Something I don't particularly think he wants.)
