Even long-deceased rock stars are being sued. After nearly 28 years, three Kansas brothers are charging that Buddy Holly copied his huge hit,

''That`ll Be The Day,'' from their song of the same title. The brothers, Al, Arthur and Allaire Homburg, just filed suit in Kansas City against Paul McCartney`s MPL Communications company, which owns the rights to Holly`s music. The brothers claim Holly heard them perform their song in the mid-1950s.

Their claim doesn't make any sense. I wonder if it was thrown out of court.
