The basketball hoops were not here before those houses around the common area.

There is no parallel for what my 2 year old witnessed except that we need a way to ban people from the area, resident or not.

Thankfully, I am not required to jump into your numbers arguement. I am not going to argue.

Fence the area in and the hoops can go back. If not, I am noting that there is a major lawsuit liability should anyone get hurt. Take that chance on your own. We are all liable since we are all members of the HOA. We need to do our due diligence.
