Dear Human Rights Advocates:

We could adequately protect our human rights and liberty if we should adopt the Grand Jury and Trial Jury justice systems.

Ever since the 1987 Constitution was approved, I have been proposing to many people in the Philippines that we make use of the Initiative Process in Article VI, Section 32, of said constitution and its "People's Power Clause" which is Article II, Section 1, of the constitution.

I had proposed as an initiative that we adopt the Jury System. And what is the Jury System by the way? It is a judicial device in which the ordinary common "legally ignorant" citizens are enabled to do justice by the exercise of their sovereign power, through a group mostly composed of private citizens called the Jury whose members are chosen blindly or by lottery under official supervision of judges with statutorily established jury instructions.

Juries perform their jobs by official supervision (but not controlled which way they decide) by a judge in arriving at their decision called a "verdict." Since the members of a jury are private citizens, they cannot be intimidated as far as their livelihood is concerned because public officials, even a president, have no control over their private employment. Even more so, if the juror is jobless. Creation of the Jury System will establish a legal partnership of justice between the ordinary citizens and judges (to prevent cheating in justice by the government against the people and vice versa. It will dismantle the present underground partnership of justice between powerful politicians and judges, the protective mother superior of grafters in high places of the government.

Under the United States Federal Jury Systems, there are ccommon two (2) general forms of the Jury. The first one is the Grand Jury (to secretly investigate and indict - accuse- in court serious crime offenders) and the second one is Trial Jury (to publicly try to convict or acquit) an indicted or accused offender of a crime. These two forms of juries have nothing to do with each other's job but they work in tandem. Without the other in the U.S., the jury system would not have been highly effective because of the great sophistication and cunningness of U.S. "educated" grafters or mobsters and which, unfortunately, the Filipino grafters are the fastest learners of their chicanery tricks.

The Grand Jury and Trial Jury systems had been successfully used to control lawlessness and government corruption in the United States for over 200 years. Without these systems, that country would have been ruled by the descendants of Al Capone, the most powerful gangster and mobster of his era. Unfortunately for him and his "company," their wits were no match to the Grand Jury and Trial Juries. Each time Al Capone was caught in his criminal activities, he ended up pleading guilty to his crime inorder to to evade longer jail sentences.

Lately, our very own Mr. Mark Jimenez, described by XP Joseph Estrada as his wisest presidential adviser, tried to do his tricks with Mr. Bill Clinton by bribing his way into U.S. politics. As you know, Philippine justice has been, and is, of no match to the wits of Mr. Jimenez and he is, and will be, home free from the inutile government monopolized justice system. But unfortunately for him, like Al Capone, his wits have also been of no match to the U.S. Federal Grand Jury. He ended up pleading guilty to every count of the crimes he committed in the U.S.

Having a Grand Jury is like having a good neighbor who can protect your rights and liberties against a bad neighbor (your corrupt government).

U.S. President Thomas Jefferson once said: "The jury is the only anchor yet imagined by man in which a government can be held to principles of its constitution."

Ever since I had suggested the adoption of the Philippine Jury systems a number of questions had been presented to me and even before I could answer them, many of them already made their "verdict" and concluded that the Filipino people are not prepared to establish it, among which were the following:

1. Almost all Filipinos do not know their laws. How can they make a decision according to law?
2. Filipinos are basically corrupt. How can a jury of Filipinos issue a fair judgment?
3. Filipinos are disunited. How could we ask them to work together and decide what is just?
4. Filipinos know very well each other. How can you prevent them from making unreasonable favor of judgment for their friends?
5. Most of the Filipinos are very poor. Many are jobless. How can you stop them from accepting bribes?
6. Private citizens are afraid of public officials. How can you ask them to indict or convict a powerful official, such as a corrupt president or governor like what has been going on all these years?

If Congress will refuse his strong recommendation to enact the proposed jury law, Mr. Vic Del Fierro is fully prepared to sponsor it as a People's Initiative for direct approval by the people under the procedures of Republic Act 6735. Invite your friends to help him in every way. He had been sacrificing his personal earnings in launching the jury adoption crusade.
