] Date Posted: Wed, Mar 17 2004, 11:00:31 Dear Fellow Timeshare victims, I managed to get a local timeshare firm to refund after nearly 3yrs of pastering, reporting to CASE, calls and making personal visit to them. I have confronted their contract officers and even met their MD but alas they just wanted to make some excuses and try to delay or even intimidate me. They once even informed me when I threatened to take legal actions that their firm employed Lee&Lee for legal services. I persisted and went to seek legal actions but later stick to using CASE as the lawyers weren't confident on wining the case. These timeshare companies knows what they are doing. Their contract basically protects them from any legal liabilities. I kept on the fight even when they decided to offer to waive 10year membership fee for my Timeshare. After numerous letter from CASE (and after 3 CASE officers have come and go). The firm finally agreed to refund. CASE informed me that the particular timeshare firm is trying to be on good terms with CASE so that maybe the reason. Another I think maybe because of the impending Fair-Trade-Agreement legislation. I got a full refund and did not paid for any of the resort fee (because I did not use it!). My advice is keep trying especially now with the Fair-Trade-Agreement in force, CASE the watchdog body now has more 'bite' to it. Always return the certicate immediately once you decided to ask for refund to show that you are determine.(if matters were to be settle in courts..). Be firm and not let the firm persuade you to change your mind even if they throw in feebies. I think ASIA is now the new haven for all these Time-share (crimeshare) companies as there were little in laws that protect consumers. We have only just implemented FTA! These international timeshare companies had a hard time plying their trade(tricks) in Europe/U.S because consumer has rights and knows of their reputations unlike us in ASIA. I think Timeshare businesses are starting to flatter (or will be) as more of us are awares of their reputations. Keep up the good fight! I bought it after 3 long hrs of high sales pressure and persuasion that I would be buying quality accomodation at today's prices, and that there are HUGE COST-SAVINGS.. The maintenance amount was actually stated in black & white. Little did i suspect that the Maintenance fees could go up. .. ATC manager spoke to us today. He warned that the timeshare owners are all changing to 'destination' packages. He said ATC Timeshare owners dropped from 7400 to about 400 TS owners, through changing to 'destination'packages. He stressed that Maintenance fees will go very high (he mentioned MTC maintenance has doubled!!).. He 'offered' a suggestion saying that we could pay $12k to change our plan to 'destination', so that we can enjoy 'greater savings'. Given this situation, the remaining timeshare owners are likely to be SHORTCHANGED into paying HIGHER maintenance fees!! Pls advise me on the course of action. I would really like to ask for Refund, and to terminate this agreement. I really cannot trust this company to provide the dream travel I thought i had purchased. Pls email me. Thanks a lot!! Yesterday, i went to ATC to meet up with an asst. manager regarding this "destination" thingy. Apparently, he told me that timeshares are phasing out in Europe and we in Singapore are also following the change to "destination". At first, he quoted 13k, but i'm obviously not very happy and he quoted a special 2-wks package costing another 5k+. I requested time to think and he told me that my file has to be submitted to Thailand before he knock of at 5pm and 8-Aug-04 is the last day to take up this offer.......so there's no time to consider. Again, want me to take up this offer immediately. I rejected, of course. I believe that there will be at least some justice in Singapore. Any legal action u have took against those conman? I believed they lied that they had sent letters out to inform existing members of this change in plan only to tell you one day before the "expiry" date that they are making a special effort to meet us since we did not respond to their offer. I doubt they would meet members in a group. As usual, they try to use all means to make people convert their plan. For me it means forking out extra SGD 5K. I just told them I am not signing anything and eventually walked off. This is sheer madness at the brazen way they are continuing to con ppl to part with their hard earned money. They made it seem like if we did not take it up, we will basically be left alone and we will have to pay up whatever ridiculous amount of maintenance fee that the resort will ask from us. We are not allowed to cancel as legal action will be taken against us if we were to do so as it is considered a violation of contract!! We have signed up after that 2hrs of pressurising and are now using credit installment payments. Anyone has any idea how we can stop payment? If we do stop, what actions will be taken against us?
