Hi

I just stop my eri contribution, its taking a toll on my financial, read up some nasty remarks that members who terminate will be sue for early membership termination.

I dun have money left for lawyers , n i certainly dun 1 to continue the instalment.

My question ;
I am not able to pay up the rest of the instalment , so will i be brought to court n jail for it.?

Wat other options are avaliable for me to cease this nonsensetical product installments?

Hi

Pls stop paying any more. The more you continue to pay the more you going to lost. Pls look for CASE for help. They can arrange help for the termination of contract. This is because if you cancel by yourself you normally will just get rejected and treaten for legal action. However thru CASE you will have a black and white letter to ask for termination and will be keep with CASE. If the time share do not respond to CASE you have the right to stop paying even they send the lawyer letter you also can ignore. According to so many forumer story so far the timeshare only send lawyer to treaten people. They will Never DARE to bring you to court to expose their BIG SCAM to public.

Hi Lawrence,

The contract that you sign is legal and bind documents.Its difficult to cancel as they have a black and white documents that is non-cancellable.In order for you to cancel,u can use lawyers to fight them back.

This thing about suing the timeshare member to pay up does not really make sense. What are the chances of successfully suing a timeshare member to pay up?

All of us know that Banks will sue creditors for defaulting on their loan payment. This it because the creditors took money that belong to the bank (legally that is). The creditor can be sued all the way till he is declared a bankrupt and repossess anything that he owns of value till the loan payment is cleared. The bank will go through anything and everything legally possible to get back “their” money.

What do you think about the Condominium industry? The condos cost many times more then a lousy timeshare membership. Do they sue buyers who back out of the sales at the last moment after paying the few thousand dollar deposit? The most that could happen is, the deposit will be lost to the developer, which we all know is the common market practice.

But for timeshare membership, you did not even take or consume anything from them yet and they persistently want to purse you to pay up. What if you are really sued? What do you think of the court judgment that will be passed? Will the court force you to continue servicing payment for a “not even once used” product, even when you are willing to forgo the initial payment and the partially paid membership? On what basis must the timeshare member be made to continue paying for what he/she does not want anymore?


I think this area of thoughts has been neglected. Please consider the points that I presented above.

Anyone can sue anyone if they feel that they are in breach of something. Win or lose depends largely on the basics of the argument of both party. In a court case, both party would be represented by lawyers. Being sued does not mean you are sure to loose the court case.

It looks that everyone seem to have this perception that being sued for not paying up, he/she will definitely loose the court case. i think this might not be the right mind set.

My point is, if they do sue you for not paying up, what are their chances of they winning the case? What are the things or points that they are able to use to overpower your argument and make you loose the case? Don't tell me you will just sit there and get hammered by their lawyer? You will also be represented by a lawyer. It a fair fight.

Just imagine if they loose the case against you. They would have to foot the bill of their lawyers. If they loose one case, they could also loose many. The cases would be almost identical. Would they take that risk?

Just like the condo example that i have quoted. You sign a contract to buy the condo, pay up the deposit. And at the last moment, you decide not to continue and forgo the deposit. Will the condo developer pursue the case for continued payment from you for breach of contract and win the case?

I believe there is a way to terminate the contract because i did terminate the contract before,but it still incurred money.And the money you pay is only once and for all.Its really satisfied.

There are several timeshare companies that we all would like to rid ourselves of. Getting rid of this whole fiasco is probably the best thing. Can we please try and generate a list of Law offices / Lawyers in Singapore who can help us? Anyone who has had any good experiences with lawyers, pls post their contact details and estimated costs involved.

I also would like to explore any possible assistance that CASE can provide. What are your experiences with CASE in this matter, including legal assistance from them or their lawyers?

Please stop paying, I have been stopping 6 months ago, nothing happen. I know a few key person have left ERI, lady & gentlement, stop paying for a few months see what hapeen, do you think any lawyer in Singapore would like to make a stand for ERI, is a wellknown money sucking company. Let's don't pay for a few months................ CASE can't do much, so what we can is to be nasty customer......... ERI need us more than we need them. WOrk together.......
