I completely agree with you. A great example of this would be when writing a college paper how we (students) use other people's work. You can either cite them (and quote word-for-word from the original text), or you can paraphrase which would fall under fair use. In academia however, an individual must still give credit to the original creator of the work even when paraphrasing. This can be done simply by saying "according to mr. x".
I think the war on copyright on-going and there is no end in sight. The internet has definitely contributed to the availability of work that would have otherwise been inaccessible to most people.
