【記者梁淑貞報道】勞工處擬於今年向立法會提交修例草案,建議遭不合法解僱的僱員在法庭裁決下可自行復職,僱主若不允員工復職,最高可被罰款五萬元,勞工顧問委員會下月一日將商議罰款準則。

《僱傭條例》訂明,僱主因僱員懷孕、工傷、病假、在執行勞工法例中作證、基於員工行使職工會權利等五種情況作出解僱,屬不合法解僱;僱主不是基於裁員、僱員行為或法例規定等正當理由解僱,則為不合理解僱,違例僱主最高可被判罰十五萬元。有關僱員經裁決後可以復職,但須先得僱主同意。

院舍照顧擬准增聘外勞

據了解,自九七年不合理及不合法解僱條文通過後,勞資審裁處每年平均處理十七宗個案,在此百多宗個案中,勝訴僱員最少只獲一元象徵式賠償,亦有十多宗僱員勝訴後要求復職,但只有個別僱主同意。

勞工處認為修例擱置多時,經律政司研究技術問題後,盡快提交勞顧會及立法會審議。

另外,因安老院舍照顧員人手短缺,勞工處建議擴大補充勞工計劃的照顧員數目,由現時院舍每三名本地照顧員可申請一名外勞,增至每兩名本地照顧員可請一名外勞,逗留年期亦由一年擴至兩年。
