"this was a TS with a sperm donor in IL"

I am sorry that you have experienced all of this. It is heartbreaking and I would not wish any of what you have experienced on anyone.

That being said, when you were asking for advice in the past (go read your old posts), you NEVER SAID THAT YOUR DH WAS NOT THE BIOLOGICAL FATHER!!! IN ALL OF THE TIME YOU AND I TALKED ON THE PHONE AND EMAILED--YOU NEVER REVEALED THAT VERY IMPORTANT PIECE OF INFORMATION--THE ADVICE YOU RECEIVED WOULD HAVE BEEN MORE ACCURATE IF YOU DID!!!

In the state of Illinois--what you were doing was not surrogacy in the eyes of the law--it was a TRADITIONAL ADOPTION BECAUSE THERE WAS NO GENETIC BOND TO YOU OR YOUR DH!!! Because of the "icky-ness" legally surrounding arranged adoptions--I had to break a good friends' heart and tell her I couldn't carry for her!! The laws for my specific situation (single IM) were just toooo murky.

Like the above poster stated--there are good surrogates out there!!! Take your time next time and "do it right".

"and each time we contacted our attorney about this we were advised to not pay her but we went ahead because she sent us threatening letters demanding money or she would sue us for breaching the contract."

I am just not sure what to think of all this. To be honest I am a bit doubtful. You had an attorney, and you say that you were advised numerous times by that attorney but you didn't follow that advise for fear of being sued for breach of contract? If the information svs posted is correct, then you couldn't have been in "breach of contract" because that surrogacy contract was never valid...something your own attorney would have, or should have, known.

In the following thread you specifically state that your husband is the biological father:

That and a few other things aren't adding up to me (and I hope I am wrong), but I wish you all the best of luck and hope that things work out for you.
