Also, most legal "agreements", otherwise known as "contracts" do terminate upon death of one of the parties--if I recall correctly from my early days of contract law... If I sign a contract with a person to buy a car and then die--this contract terminates with my death--a very simple example, but that's generally how it works. The lender could file a claim with my estate, but if there is no money in the estate--they will get nothing. The difference with a will is that it must be filed with the state to give it "legal life" after the passing of the person. Otherwise, it might as well be written on a napkin in crayon... (And unfortunately, some wills are done that way!)
