3. Whilst the above guidelines are provided to facilitate handling of the unauthorized amenity feature, consultants are reminded to examine each ease on its own merits before making a recommendation. Depending on the circumstances of each case and with due justification, the approach may also be extended to other unauthorized amenity features. In case of doubts, the consultant should consult the Director's Representative.

4.When approach for advice, consultants should only comment on whether BD would take enforcement action on an unauthorized amenity feature based on the above guidelines. Advice should not be given in any way which may imply that property owners could follow the above guidelines if they intend to construct amenity features. Consultants should also impress upon owners that even though an unauthorized amenity feature is not acted on by BD at present, it will continue to be regarded as UBW and will be subject to immediate enforcement action when changes in circumstances so require it in future.
