If you have prior opportunity, then you must dispose of it legally. If you have no prior opportinity, all you have to do is con the ump into believing you made a genuine attempt

The definition of prior opportunity isn't well inderstood among punters either, IMV. There's fend offs, head ducks and having taken a mark or free but also it's enoigh to have been "balanced and steady" and in possession. Nothing about timing or how many steps or spins in a tackle. (Page 15 of the book for those reading along at home)

So yeah... if you take possession of the ball as you are falling to ground under a tackle then yes, you could legally throw it, as long as you waved enough of a fist at it as well. What players are more likely to do though is have ot "jarred free" in the tackle (rule 18.6.3.b)
