Absolutely. Except in a very few US states, private donor contracts made before the birth of a child will not be enforceable, though a judge may use them in determining the best course of action. I still think that a written contract is essential so that both the donor and recipient know what they're agreeing to.

As long as the mother doesn't name the donor, and the donor doesn't seek any connection with the child, then there is no legal father.

It is possible in some places for someone else (often a lesbian mother's partner) to adopt a child, which would limit the donor's rights to custody though probably not access. I've even read of cases where the birth mother gave up her rights to the child so that her partner could be the legal mother.

It is now possible in France, some US states, and soon the UK for lesbian couples to co-adopt. This is not possible before the birth though, and in some places, the consent of the donor is needed.
