Well John lets tell this story as it actually happened.

First off I sold you a puppy in the spring of 2008.
You later contacted me and said your pup had developed HOD and your Vet-boss said it was probably genetic.
I had no HOD in my dogs so I doubted that it was genetic, but on the other hand I didn’t know that it wasn’t. I didn’t know anything about HOD. You were very sad about the situation and one pup more or less isn’t going to bankrupt me, so I said I would replace him with a male from my next litter.
In the 7 or 8 months it took before I had another litter I looked up “HOD” on the internet.
I found several sites and they said,
. There is mounting evidence that viral infection may be important in the disease., with Distemper virus detected in the growth plates of dogs with HOD (Mee, 1993).”
“The research is in year 5 of a 7 year study on Vaccine Mediated Responses in Canines.
“I mention this information to you because there is evidence, based on the national survey, that vaccine reactions, allergic reactions to certain antibiotics, and septicemia (generally from cropping), are often misdiagnosed as HOD. These conditions can "mimic" the same symptoms as HOD , making it very difficult to diagnose. “
In the textbook Small Animal Clinical Nutrition, 4th edition 2000 has these diseases HOD, OCD and Panosteitis (Pano) listed as DOD - Developmental Orthopedic Diseases and nutritionally related, not genetic in origin”
“The prevention lies in understanding what causes this disease. Unfortunately, there is currently incomplete consensus on the cause of this disease. Some have hypothesized that there is a bacterial cause”
“Another suspect in the disease is vitamin C”
“The most accepted cause for HOD may be nutritional. There is evidence that several bone diseases of young dogs are linked to feeding an excess of protein and calories in the diet.. Studies have not been conclusive, though many owners of large and giant breed puppies begin transitioning from densele caloric, high fat and protein puppy food, to adult food at 6-7 months, rather than at the traditional 1 year. It is possible that this disease may be caused by several of these aforementioned factors. Clearly more future research will needed to more conclusively pinpoint the cause of HOD and other skeletal growth disorders.

So, it is clear that HOD IS NOT commonly thought to be genetic. My guarantee for your puppy provides for protection against “serious genetic defects” and further “Buyer is responsible for all shipping costs.”
It is obvious that I didn’t –legally- owe you anything. But, you were very saddened because you thought you had to put your pup down and had done so. And again, I HAD told you I would replace your pup. I did so with a pup from my next litter.
Now you go into great detain about how many phone calls you tried to make to me shortly after you got your pup. I was on the road, my cell phone battery was dead and I didn’t hear about your concerns until I called home around midnight to let Barbara know I was still among the living and was off the road for the night. She told me you had called and were upset about your puppy having a “heart murmur”. I called you first thing in the morning and expressed my belief that your pup was merely stressed by the day-long trip in a crate and that he would be fine. You said at that time that you sort of agreed with me. He seemed a lot more mellow that morning and his heart seemed to have quieted down. I told you to relax and enjoy your pup and that if something DID go wrong I would replace him with another pup from my next litter. If I remember correctly we left it at that. I received an email from you .
(you can understand that in light of your Vet’s misdiagnoses on the HOD puppy I have little faith in his latest reports)

Here is the update I brought him in today and we viewed his heart via ultrasound and it was not good. He has an irregular heart which is the cause of the murmmer and them some other vet terms which I can send you but I really was not listening at that point. I had hoped it would go away. I am crushed as so is my family as he is an awesome pup very bold and outgoing showing good drives also. I understand these things happen just one right after another sucks. Well I guess I would like to know where do we go from here ?

I replied that I thought your vet was an alarmist and the pup would be fine. Wait and see I also said that I had no pups to replace him with right now anyway..
You responded If you are so sure he will be ok I can bring him to you and you can sell him to someone else and I will require my money back 1000 plus 250.
My reply was
John, I called you the next day and you said that the pup seemed fine and the heart murmur was no longer obvious. I said then that if he came to any harm because of it I would replace him, which I will. But I was long down the road when we talked and you would have had to bring him up here yourself. The other bitch did not have any pups, so I have no pups.
My question at this time is what caused you to have him examined today? At any rate, my guaranty offers to replace a defective pup with another, not refund money. I think he is a fine pup with no physical problems but you are looking for some. I hope he grows into a fine dog, but if he does not and he dies because of a heart-related problem I will replace him with a pup from my next litter. You will be responsible for the shipping costs.
You said “I will drive him back up there” “If you are unwilling to refund me back $1250 upon returning the male puppy then I will explore other options”.
Once again I replied
I think he is a fine pup with no physical problems but you are looking for some. I hope he grows into a fine dog, but if he does not and he dies because of a heart-related problem I will replace him with a pup from my next litter. You will be responsible for the shipping costs.
You then sent another message.
I do not have a problem with the puppy he is a fine pup and is what I was looking for in a pup. I have an issue with his serious heart defect and also that you will just probably sell him to someone who will have no idea of his heart defect and I am sure you will not disclose it to them.
You have just called my a liar and a thief.
Your message continued
I also do not feel I will ever get a healthy pup or even a pup at all, at this point I have no other option than to refer this matter to a lawyer and present my evidence and vet reports to the courts to recover all my out of pocket costs.
You have now threatened me with legal action. All this over a free puppy. I don’t respond well to threats or being labeled a crook. Especially when I was doing you a favor in the first place.

I sent you another message stating that my dealings with you were at an end. I gave you two weeks to return the pup and I would STILL replace him with a pup from my next litter, but because of your attitude I would not replace the pup after that.
It has been over a month. Your pup was free. Evidently your lawyer has informed you of this and the fact that I even then offered to replace him under the terms of my guarantee , mine has informed me of the same thing. Now, go learn some manners
