There are really two prongs to this argument. The first is philosophic, the "should we be better than them, or more "moral" a word which gets tossed around too haphazardly by both political parties in my view.

The second is the practical. The real time, real world problem of having people trying to harm us, our families and fellow citizens, and grappling with the problem of how to stop them.

I believe that the practical argument overrides the philosophic one. From what I've seen the tactics were legit. The timing of the release of this is questionable. "Take their eyes off of the healthcare debacle" comes screaming through to me.
