 I am not a lawyer but...

From my limited understanding of current Data Protection legislation, they are probably alright using the information internally - but if they try to sell they would be in trouble as we have not been asked if the data could be made available to third parties. Depending on the exact realtionship between the Hall, the BBC and 'The Proms' these may count as third parties.
