Correct, it is a public road and no one can stop anyone else from riding on it, but if people care about the event, the organiser and the regeistered riders they wouldn't ride on the day of the event.
If people are desperate to ride the route then they can. It just would be better if they chose a different day.
If all they want to do is ride the event, get your entry in early, cross your fingers and quit complaining when you don't get in.
