Sounds reasonable, but will that argument protect you legally? Your example is evidence that we can get screwed by people, institutions or the law. The law is often a reflection of who has power, not necessarily what is good for the people involved. Who is deciding whether someone in any particular relationship can be coerced into accepting a beating? And what is the mainstream view of corporal punishment?
