Ruane hits out at court's refusal to grant judicial review of ASBO's


Sinn Fein has serious reservations both about the substantive nature of the
Anti-Social Behaviour Orders (ASBOs) being proposed in this Draft Order, and
in the manner in which the Order is being processed. The combination of
fundamental flaws in both process and substance means that we are unable to
support the introduction of ASBOs. The British Government should abandon the
timetable it is currently running to in order to enable a comprehensive
consultation process to be carried out and to give a commitment that it will
take that consultation process seriously.

Sinn Fein's Human Rights and Equality spokesperson Caitriona Ruane was
highly critical of Wednesday's High Court decision that refused the
Children's Commission leave to apply for a judicial review of the proposed
introduction of ASBOs to the Six Counties. "The NIO has failed to fulfil its
obligations under Section 75 of the NI Act and I am deeply disappointed that
the Children's Commission are not going to appeal this decision".

"Recently I attended a meeting with my party President Gerry Adams where we
met with ten Human Rights and Children's organisations who have all objected
strongly to the speed with which direct rule Minister John Spellar has
rushed through this process. The High Court's decision not to grant the
Children's Commission a judicial review undermines their authority and
totally discounts their expert opinion. It also emphasises the disregard
un-elected and unaccountable representatives like John Spellar have for the
democratic process here in the north".

"Despite what the British Government is saying, the people of the six
counties have not 'resoundingly said yes' to this legislation and there is
little evidence from their use in England that ASBOs work. What is needed
is better resourcing for initiatives such as Community Restorative Justice
that provide long-term solutions to the rise of anti-social behaviour and
criminality. It is also important these resources are allocated to already
marginalised communities that our most affected by this problem.


"Children and young people are being ignored and have been excluded by the
British Government who have refused to discuss with them their proposals.
The NIO is also failing the people of the six counties by attempting to
introduce legislation that further undermines the institutions established
to protect a society emerging form conflict, and which has a remit to
protect the rights of all children.
