In the hypothetical case that Terry divorces and she OR her former husband disputes paternity, and that is granted through the court - then there is no obstacle to seeking support from the biological source. If both legal parents, and the biological father keep quiet, there is no issue. If the biological father wants access, it is again a court issue.

Some law systems stress the importance of the length of time the husband knew about the extramarital source of the child in deciding whether to agree to his refusal of paternity. But this is shaky ground, and I wouldn't like to be in the unfavourable position of the judge, who would deny the claim of refusal on the time length issue.

The presence of agreements doesn't mean that there is no legal basis. The way I understood the Kimberly Quinn/David Blunkett controversy was that she was very intent in shutting him out completely out of the life of his child. Most people only go for agreements if they are convinced that the court would rule that way anyway, and this simply spares them the additional embarassment. After all, Kimberly Quinn has a relatively public job...
