I’ve been away and I’ve finally had a chance to catch up down the board. Some people argue that Harm was being ‘immature and unprofessional’, and others on the board arguing he was not.

Here’s the theory I’m throwing out. Yeah, I think Harm was being pissy in last Tuesday episode. But don’t you think Harm has a reason to be a bit pissy about Mac getting appointed a judgeship first? Frankly, I think his behavior last Tuesday had NOTHING to do with Mac. I think it was frustration towards AJ bubbling over. Mac was just the safest and most convenient target for him to direct it.

Who here hasn’t taken a healthy dose of frustration out on a loved one occasionally?

Why does Harm have grounds to be suitably irritated and frustrated that Mac got appointed to the bench first? Let’s compare his and Mac’s records and I’m NOT slamming Mac here.

1. Harm has been at HQ longer than anyone. Even taking away the six months he served on a carrier Harm has still been at HQ longer than Mac has. I’m betting if Harm in fact did go to Georgetown law school all the time he was a law student he was probably pulling double duty doing research.

2. Courtroom record for courtroom record Harm’s record is better than Mac’s. All we have to do is look that the wins and losses.

(I think it was also stated in the pilot that for his first two years as a JAG Harm never lost a case. A record no one else has ever managed to match. I think it was stated in the pilot as part of the Rabb legend and explanation for how Harm climbed the ranks of JAG so quickly. Please forgive me if I’m wrong it’s been a LONG time since I’ve seen the pilot.)

3. Harm has NO serious infractions or blotches on his record. Mac does. Mac has an Admiral’s Mast on hers. An Admiral’s Mast is a BIG blotch on a record. Not to mention any disciplinary action Mac might have faced for using that forbidden file in court.

Even if Harm got officially written up for his handling of the case in ‘Thin Air’, it’s not even CLOSE to an Admiral’s Mast.

4. Mac only has two months seniority over him. As Catmom has explained considering both of them belong to two different branches of the service and the promotion boards meet different times. Those two months between them really mean absolutely nothing.

Harm messes up ONE case because he wasn’t ‘impartial’ and AJ is holding that against him? A case Harm even asked not to be assigned to. Did it ever occur to AJ Harm asked no to be assigned to the case because Harm –knew- he couldn’t be impartial? No.

Sometimes the greatest test for a judge is knowing WHEN to step down from a case.

Heck, Harm shouldn’t have been assigned to the defense table at all considering he was the investigating officer that recommended charges. Not to mention, possibly on the prosecutions witness list. Assigning Harm that case was really putting him in to a no-win situation. If he did his job as a defense attorney that would mean proving he messed up as the investigating officer bringing up charges against that kid in the first place. How can AJ honestly expect Harm to walk in to that court room being ‘impartial?’ NO one could. Harm would have to be Superman or a robot to pull it off.

AJ has given Mac a case that even remotely tests her ‘impartiality’ like that lately? No. I can understand why Harm’s might be VERY frustrated that Mac got appointed to the bench first.

If I was in Harm I would be more than just a –little- frustrated. Heck, if I was in Harm’s shoes (and I have been) I would be more than a little pissed about the whole situation.

I know someone argued that Harm’s Flight Jock ego can take the blows and AJ knows it. That taking Mac’s and Bud’s past in to consideration AJ has to treat them with the kid gloves more and that’s why he comes down harder on Harm than any other member of his staff. Maybe, but I think AJ tends to forget that under Harm’s cocky mask is a fatherless little boy who is still desperately looking for a father to please. A little boy who desperately wants to hear his father say he is proud of him.
