Subject: Cancellation of Contract with LGM

hi all,

I cancelled my contract with LGM but had to pay the so called cancellation fee of $500. It wasnt the ideal outcome but at least they agreed to pay me the rest of the money.

Just a few pointers to share so that the company wouldnt dare intimidate.

1. Bring friends along (if you are a lady - bring male friends!) IF you have friends who are trained in law, ask them to come along as they will know whether the company is abusing the consumer)

2. Never never allow them to split you and your friends up. Thats what they try to do to me and my friends. They dont want any witnesses to their tactics. ANd they are definitely more civil in the presence of others.

3. Be calm and refuse any other offers they may use to entice you with. Focus on your message (prepare in advance why you want to cancel the contract) and keep repeating it to them.

4. Get a copy of the cancellation letter and confirmation of when they will pay the money.

In addition, once FTA comes into effect on 1 MArch 04, consumer wil have the right to cancel contract within 3 days (excluding Sat, sun and PH) and get full refund. I believe it overrides the company's contract. Also if the company practice unfair trading (like misleading clients) consumers can also cancel on those grounds.

Best of all, if the company does not bring the FTA to the consumer's attention at the point of sale, consumers can still cancel contract even when 3 days have lapsed.

does FTA applies to contract signed before 1 March if I sent in the termination letter before the cooling period ends?

hi Koala

yes, it was within the 10 day cooling period stated in the contract. But they gave me a hard time, and as you read other stories on the website - they tricked some people by saying they cannot cancel even within 10-day period because the reason were not valid.

but I am doing my best to help others who are in the same shoes now.

I was very disappointed with CASE when I went there to seek their help to cancel my agreement with LGM within 10 days of signing. The lady said my agreement was legal binding and I have no case as I did not have a cooling off period.

Hi Elsie,
The cancellation was timeshare or CVC?
In 2001,we were mislead in signing for timeshare(Holiday ownership -LGM),thinking all the goodies were true and were given the cooling period of ten days. But to terminate within this period "MUST" have a "VERY GOOD" reasons with documentation as proof eg death, retrenchment or fatally ill.So we feel there's no way to void the contract.
After full payment by monthly installments,we were conned again in 2003 for CVC in thinking we could get back the money under the CASHBACK, guaranteed by the sale person. In this contract,no cooling off period and not given because they said we are already members of LGM,so is not given. As soon as we knows about all their tactics, we discontinue from paying the balance.

HI Elsie,

I have yet to cancel my contract or get a refund from ERI since i signed the contract 1.5 months ago. I went back to confront them within the few days of signing the contract and even approached CASE for help. However I feel that CASE has been pretty passive in their actions. I have thought of seeking legal help, but my boyfriend (who signed the contract jointly) is hesistant about doing the same. I don't feel good that the matter's been hanging.

How was the process of your resolution like? Are there any other alternatives? Did you have to engage a lawyer during the resolution of your case?

My email is nix1981@hotmail.com, if it's possible for you to contact me directly.

That's strange, since on CASE's website under Media, CASE had applauded LGM for giving their members a 10 days cooling off period.
