WHITE PLAINS, Feb. 8 1973—Humbert M. Cappelli, suspended Police Chief of Newburgh, was found guilty today of 12 of 14 charges of corruption, including the planting of narcotics at the scene of police drug raids and the stealing of money uncovered during the raids.
A State Supreme Court jury here returned the verdict late in its second day of deliberations following a five‐week trial. Justice George Beisheim Jr. revoked Cappelli's $250 bail and sent him to the Westchester County Jail to await sentencing on March 3.
The suspended Chief faces a maximum of 43 years in prison for the felonies of grand larceny and eight counts of tampering with physical evidence and for conspiracy to plant drugs, a misdemeanor. The jury acquitted him on two larceny counts.
The 44‐year‐old Cappelli, who rose through the ranks from patrolman to Police Chief, observed his 20th anniversary on the Newburgh force during his trial.
The defendant was the second of 16 Newburgh policemen —almost one ‐ fourth of the force—to be tried on charges of corruption resulting from investigations a year ago by the Orange County District Attorney's office and the New York State police.
Twelve policemen have already pleaded guity to reduced charges. A 13th, former Patrolman David Birdsall, was convicted of burglary, and two others remain to be tried.
John Onsher, who was deputy chief under Cappelli, is the Acting Chief now.
All the cases were moved to Westchester County on the ground that it would be difficult to find impartial juries in Orange County.
The prosecution drew its star witnesses from those of Capelli's former subordinates who had already pleaded guilty. They testified that they and the Chief had divided hoards of cash found at the scene of several police raids.
In his summation to the jury on Tuesday, Cappelli's lawyer, Gilbert McCormack, attempted to discredit these witnesses as confessed criminals who “took advantage of the Chief” and who “tried to make up stories implicating him” to conceal their own wrongdoing.
