A client has been told by an Education Department worker that she is not allowed the Advocate of her choice because of a decision by the Director of Social Services who will only 'allow' Advocates 'approved' by her. This decision which has been made in relation to a user led Advocacy service has been made and colluded in by other Statutory agencies and whilst we are challenging it, the Client is not 'allowed' a voice because she does not want the 'voice' they choose to allow her to have.
We have been having problems with the current Director of Social Services and the manner in which she 'achieved' a second star arguably at the expense of services.

There is still considerable controversy over the definition of independent non-legal advocacy for individuals who need it. In Britain in recent years the idea has increasingly crept in and been widely accepted that advocacy should only be about respecting the choices of the person advocated for. This is a simple and seductive idea: who could possibly object to empowerment? However, I believe that this greatly restricts the scope and benefit of advocacy. Historically, the concept of independent non-legal advocacy has had three origins. Wolfensberger, who founded the concept of Citizen Advocacy, saw it as protecting people from harm; his viewpoint came from studying what happened to disabled people, gypsies, Jews and other groups in Nazi Germany. John O'Brien saw social exclusion as a major problem for disabled people and other groups; the emphasis in his definition is thus on social inclusion. Alongside these concepts, the self-advocacy movement of many groups proclaimed the need for empowerment, choice and rights. In my view, an advocate for a person needs to consider all three kinds of need of the person they are advocating for: their need for protection from harm, their need for inclusion in mainstream society, and their need for respect for their choices. Usually there will be no conflict between these needs, but occasionally things are more complex. Some of the situations where respecting choice may not be paramount are: when the person's choice cannot be known, where the possible choices are beyond the person's experience, where the possible choices are beyond the person's capacity to understand, where the person's choice is harmful to others, or where the person's choice in the short term is likely to damage their long-term health or social status. If you are advocating for someone with fairly moderate learning difficulties, for example, these difficult issues may never arise, but they can be common in advocacy for offenders, people with drug or alcohol addiction, people with severe mental illness, people who are suicidal, people with severe or profound learning difficulties, and people with extremely unhealthy lifestyles. These are people who really need advocacy, but the advocacy cannot be based solely on respecting choice. The advocate cannot shirk the extremely difficult responsibility of judging and pursuing 'best interest'. My belief is that in these situations no-one can tell the advocate what to do. Only the advocate can decide, based on their relationship with the person. Having been in this situation as an advocate, I can live with being accused of being patronising and disempowering, knowing that the intention of my advocacy has been long-term benefit for the person in health, social inclusion or protection from harm. 'What right do you have to dictate to other people what to do?' people ask me. I have no 'right', but I do think I have a responsibility to contribute to avoidance of harm and to social inclusion for people who are at risk or are excluded. In principle I also of course support empowerment, choice and rights, but not above all other considerations. So please don't let us go down the road of insisting that advocacy must in all circumstances respect people's choice. This would exclude a great deal of invaluable advocacy that goes on for people who are greatly at risk.

Is anyone out there awware of any good evaluation packages/tools that we can use when evaluating the effectiveness of our service? At the moment we distribute a questionnaire to service users but we are finding it only measures a very small part of their 'experience'. We are ideally looking to find other groups who have an effective way of measuring how satisfied clients were with the advocacy services provided.

I would like to hear from anyone who has had the experience of adding extra support hours to a direct payment package that is already up and running. We are an advocacy agency and one of our advocates supports someone who receives direct payment for their support worker but really needs more hours to provide enough support. housed by private companies. This is resulting in relationships being
broken up and older people having to relocate to new areas where they
have no familiar contacts. I am writing this up for the next issue of
Community Living and would be interested in hearing if any of your
members have experiences they would like to share (these could be
anonymous if wished). Would it be possible to circulate them with this
request?

Our Trustees are considering incorporation. We provide citizen and issue based advocacy throughout Shropshire, employ 3 - 6 people and use more than one funding pot. We would like to hear from other organisations who have also considered incorporation and either decided not to go ahead, or have incorporated and the basis on which they made their decision. It seems that the only real reason to do so is to limit the personal liability of the trustees. However, it does not protect against incompetence or fraud. Another option would appear to be a limited partnership - anyone have any experience of that?

During the interview of a volunteer, they asked me what they should do if their partner disclosed abuse to them? Bearing in mind the principle of loyalty to the partner, and if the partner wished this not to be disclosed further, how would you answer the volunteer?

I am currently working on a project which allows advocacy input for individuals within a long-stay hospital who are to be moved into supported living. Due to the vast communication difficulties the principles of advocacy are being challenged. For example, an individual who has spent the majority of their life within a long-stay hospital environment, even with the best person centred planning may not have a clear idea of what would be the best move for them. As an advocate I am aware that I have to produce information for this decision making process however, this is proving very difficult. I am currently using the BILD advocacy publication for people with learning difficulties, but would like to know of anyone who has previously been in this situation or can recommend any literature or aids. Alternatively, I would like to hear of anyone who has found themselves consulting best-interest advocacy, or if anyone has any good literature or examples of this work.

There is increasing interest in offering advocacy support to young learning disabled people in transition (broad range 14 years - 25 years)from school to adult life. It seems clear that young people look to people around their own age for support. Has anyone had experience of recruiting, supporting (and keeping ) young people as advocates? I would be interested to hear what worked and what didn't! so it can be shared among the increasing number of projects working with young people.
